Digital License

Please read this Digital Image License

By purchasing a Download Image(s) you are agreeing to this License.

As we can accept your order and make a legally enforceable agreement without further reference to you, you must read this Digital Image License to make sure that you contain all that you want and nothing that you are not happy with.

Application

This Digital Image License will apply to the purchase of Download Image(s) by you (the Customer or you). We are Kathryn Hopkins with e-mail address Kathryn@KathrynHopkins.co.uk; (the Supplier, the Artist, us or we).

These are the terms on which we sell all Download Image(s) to you. By ordering any of the Download Image(s), you agree to be bound by this Digital Image License.  You can only purchase Download Image(s) from the Website if you are eligible to enter into a contract and are at least 18 years old.

Interpretation

Consumer: means an individual who is purchasing the Downloadable Image

Contract: means the legally-binding agreement between you and us for the supply of the Downloadable Goods and Services;

Download Image(s): means the downloadable goods advertised on the Website that we supply to you of the number and description as set out in the Order;

Order: means the Customer's order for the Download Image(s) from the Supplier as submitted following the step by step process set out on the Website;

Website: means our website www.kathrynhopkinsphotography.co.uk on which the Download Image(s) are advertised.

Digital Image Licensing

The Artist grants the customer a non-exclusive, non-transferable perpetual personal-use license to download and copy the accompanying Download Image(s) subject to the following restrictions:

- this license is for personal use only. Personal use means non-commercial use of the Download Image(s)

- title and ownership, and all rights now and in the future, of and for the Download Image(s) remain exclusively with the Artist

- there are no warranties, express or implied. The Download Image(s) is/are provided 'as is'

We will not be liable for any third party claims or incidental, consequential or other damages arising out of this license or the customers use of the Download Image(s).

How the Download Image(s) can be used by the customer:

For personal, non-commercial use of the Download Image(s) includes:

- display on personal websites and computers

- make prints for personal use only in any size at and below the original size of the Download Image(s)

Restrictions to use of the Download Image(s):

Customers are not allowed to:

- use the Download Image(s) in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration

- use the Download Image(s) in advertising

- use the Download Image(s) in a pornographic, obscene, illegal, immoral, libellous or defamatory manner

- edit the Download Image(s) in any way other than size, crop, or the addition of a border.

- incorporate the Download Image(s) into trademarks, logos, artwork, or service marks

The Artist, Kathryn Hopkins, retains all rights, license, copyright, title and ownership of the Download Image(s).
